Background

Brad McDowell has been a registered nurse since 2008, predominantly working in direct patient care settings such as the Intensive Care Unit and the Emergency Room. In January 2021, he began working as an intake nurse at the Behavioral Health Unit at Winchester Medical Center, a part of Valley Health. On July 19, 2021, Valley Health announced a mandatory COVID-19 vaccination policy for continued employment, with exemptions for medical and religious reasons.

Brad submitted a timely request for a religious accommodation on August 10, 2021, which was refused by Valley Health. He submitted a revised request on August 15, 2021, which was also denied, despite Valley Health granting similar accommodations to many other employees. Brad was terminated on September 22, 2021, based on his religious beliefs.

Discriminatory Treatment

In his filing, Brad shows how Valley Health’s actions and justifications reveal a discriminatory attitude toward his religious beliefs. Despite Brad’s consistent adherence to safety protocols and the administrative nature of his role, which minimized close contact with high-risk individuals, Valley Health claimed his religious exemption request was invalid. This was despite accepting similar requests from numerous other employees.
